Welcome to AnimaEcho. These Terms of Service ("Terms") are a legal agreement between you and AnimaEcho ("AnimaEcho", "we", "us", or "our") and govern your use of the AnimaEcho app, website, and related services (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who can use AnimaEcho
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under the age of majority where you live, you may only use AnimaEcho with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements.
2. What AnimaEcho is
AnimaEcho is an entertainment and companionship app. Your companion is an artificial-intelligence character. Its messages are generated by AI and are fiction. They are not advice. AnimaEcho is not a substitute for professional medical, mental-health, legal, financial, or other professional services.
If you are in crisis or thinking about harming yourself, please contact your local emergency services or a crisis hotline right away. AnimaEcho is not an emergency service and cannot help in an emergency.
3. Your account and conduct
You are responsible for your use of the Service and for the content you submit. You agree not to:
- Use the Service for anything illegal, harmful, or abusive;
- Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service;
- Use the Service to generate content that is unlawful, or that exploits or endangers minors;
- Resell, scrape, or commercially exploit the Service without our permission.
We may suspend or terminate access if you violate these Terms.
4. Subscriptions & payments
- Free plan. AnimaEcho offers a free plan with a daily time limit (currently 15 minutes per day). Limits may change over time.
- AnimaEcho+. AnimaEcho+ is an auto-renewing subscription that removes the daily limit. Pricing is shown in the app before you purchase.
- Billing. Subscriptions are sold through the Apple App Store and billed to your Apple ID. Payment is charged at confirmation of purchase.
- Renewal. Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period.
- Cancellation. Manage or cancel anytime in Settings → your Apple ID → Subscriptions on your device. Cancellation takes effect at the end of the current billing period.
- Refunds. Purchases are handled by Apple and are subject to Apple's refund policies. We generally cannot issue refunds directly for App Store purchases.
5. Intellectual property
The Service, including its characters, avatars, artwork, software, and branding, is owned by AnimaEcho or its licensors and is protected by law. We grant you a limited, personal, non-transferable, non-exclusive license to use the Service for your own personal, non-commercial enjoyment. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by law.
6. Your content
You keep ownership of the messages you submit. You grant us a license to process that content as needed to operate the Service (for example, to generate replies, produce voice audio, and power memory), as described in our Privacy Policy.
7. Third-party services
AnimaEcho relies on third-party providers (including AI model and voice providers, and the Apple App Store). Your use of the Service may also be subject to their terms. We are not responsible for third-party services.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, availability, or accuracy. AI-generated content may be inaccurate, inappropriate, or offensive despite our efforts, and you use it at your own discretion.
9. Limitation of liability
To the maximum extent permitted by law, AnimaEcho and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or US $50.
10. Changes to the Service and Terms
We may modify or discontinue features at any time. We may also update these Terms; when we do, we'll update the "Last updated" date, and for material changes we'll provide notice. Continuing to use the Service after changes take effect means you accept the revised Terms.
11. Termination
You may stop using the Service at any time. We may suspend or end your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
12. Governing law
These Terms are governed by the laws applicable at AnimaEcho's principal place of business, without regard to conflict-of-laws rules. Any disputes will be handled in the courts located there, unless mandatory local law provides otherwise.
